These Terms of Service (“Terms”) govern your access to and use of Dalary, Inc.’s website and product (the “Service”). By using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you agree on its behalf.

The Service

Dalary drafts social media posts and cover art, schedules them, and — once you approve — publishes them to the social accounts you connect. You are responsible for reviewing and approving content before it is published.

Your account & responsibilities

  • Provide accurate information and keep your credentials secure.
  • You are responsible for the accounts you connect and the content you approve, and for ensuring it complies with the terms of each social platform and applicable law.
  • Do not use the Service to generate or publish unlawful, infringing, deceptive, or abusive content, or to violate the rules of any connected platform.

Content & ownership

As between you and Dalary, you own the content you provide and the posts generated for your brand, subject to the terms of the AI providers used to generate them. You grant us the rights needed to operate the Service, including generating, storing, and publishing content to the accounts you connect.

Plans, billing & cancellation

Paid plans are billed in advance on a recurring basis through our payment processor (Stripe). You can cancel at any time; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law.

Third-party services

The Service integrates with third parties (such as social platforms and AI providers). Your use of those services is subject to their own terms, and we are not responsible for their availability or actions.

Disclaimers & limitation of liability

The Service is provided “as is” without warranties of any kind. AI-generated content may be inaccurate; you are responsible for reviewing it before publishing. To the fullest extent permitted by law, Dalary is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid us in the twelve months preceding the claim.
